These Terms constitute a legally binding agreement between you and SentinelOps Pty Ltd (ABN pending) ("SentinelOps", "we", "us", or "our").

The SentinelOps name, logo, and all related product and service names, design marks, and slogans are trade marks of SentinelOps. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Website are the trade marks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial informational purposes only. This licence does not include the right to reproduce, distribute, modify, create derivative works from, publicly display, or publicly perform any Website content without our prior written consent.

Our total aggregate liability arising out of or in connection with these Terms or your use of the Website shall not exceed one hundred Australian dollars (AUD $100).

6. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

To the extent that our liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to:

  • In the case of services: the supplying of the services again or the payment of the cost of having the services supplied again
  • In the case of goods: the replacement of the goods or the supply of equivalent goods, the repair of the goods, or the payment of the cost of replacing the goods or acquiring equivalent goods or having the goods repaired

The Website is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, to the maximum extent permitted by applicable law. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be available at all times, uninterrupted, secure, or error-free, or that any defects will be corrected. We do not warrant that the results obtained from the use of the Website will be accurate or reliable.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. 11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia and the State of Queensland. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia for any disputes arising out of or in connection with these Terms.

12. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may refer the dispute to mediation administered by the Resolution Institute (or its successor body) in accordance with its mediation rules. If the dispute is not resolved through mediation within 60 days of referral, either party may commence legal proceedings in accordance with the governing law and jurisdiction provisions of these Terms.

13. Termination

We may terminate or suspend your access to the Website at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Website will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SentinelOps regarding your use of the Website and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and SentinelOps with respect to the Website.
